A 29-year-old Wilson man is free on bond after being charged with the rape of a child in Carter County District Court Tuesday.


Prosecutors filed a first-degree rape charge against Cody Shane Brawley early Tuesday. Brawley subsequently made an initial appearance in district court where bond was set at $15,000. A spokesperson for the county jail said the Wilson resident was released after posting bond.


The charge is based on a Carter County Sheriff’s Department investigation into a whispered 911 call Sunday night. Undersheriff Milton Anthony said CCSD dispatchers received the call about 9:20 p.m. from a child who said she had been raped. But before more information could be gathered the child abruptly hung up. A return call to the originating number was answered by Brawley, who denied anyone had dialed 911.


Deputies Chris Fitzgerald and Josh Robinson were dispatched to investigate. When the deputies arrived, Brawley was located inside the residence. He again denied the phone call, but admitted a number of children were asleep inside the house. Deputies determined one of the children, under age 14, had made the call. Fitzgerald and Robinson took all of the children into protective custody. The victim was taken to a local medical facility, while the other children were placed under the care of a relative.


Anthony said Tuesday the investigation continues, but the preliminary inquiry produced evidence Brawley had sexually assaulted at least one of the children. The undersheriff said there were indications the child may have been abused multiple times.


“She (victim) said she called 911 because she was tired of it,” Anthony said, while discussing the CCSD’s response to 911 calls, including hang ups.


“When we get a 911 call, whenever and wherever that call might originate, we are going to check it out. And the very reason for that is something like this,” he said.


Brawley was arrested without incident Monday and booked into the Carter County Detention Center. His next court appearance is set for March 12.
